Legal obligations — in brief

Every company that collects, processes or stores personal data has a legal obligation to comply with the General Data Protection Regulation (GDPR – EU 2016/679).

In certain situations, organisations are required to appoint a DPO (Data Protection Officer), in particular where they:

  • are public authorities or bodies (with the exception of courts);
  • process sensitive data on a large scale (for example health, political opinions, religion);
  • carry out systematic monitoring of data subjects (online platforms, applications, CCTV systems);
  • process personal data on a large scale and on a regular basis;
  • carry out international transfers of data to third countries.

GDPR compliance is not just about documents. It requires real control over data flows, appropriate technical and organisational measures, and the ability to demonstrate compliance with the legal requirements at any moment.

Failing to comply with the GDPR can lead to fines of up to 4% of annual worldwide turnover or EUR 20 million, as well as significant reputational damage.
